The following terms and conditions apply to the commission service provided by Tsukuyomine's Fragments/A Jellyfish Company to you, the Client.AcceptanceIt is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions an art piece or a written piece from A Jellyfish Company then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.Please read these terms and conditions carefully. Any commission or use of services implies that you have read, understood and accepted these terms and conditions.Price QuotationsCharges for services to be provided by A Jellyfish Company are defined in the price quotation that the Client will receive, upon request, via Discord/Twitter DMs. Quotations are valid for a period of 30 days. A Jellyfish Company reserves the right to alter or refuse to honour a quotation after expiry of the 30 days.Additional ExpensesThe Client agrees to reimburse A Jellyfish Company for any additional expenses incurred for the completely optional details.Reference ProvisionThe Client will be required to provide suitable references for the commission work to be produced. The Client must have permission to use such references & it is their responsibility to not breach any copyright laws.Request progressOnce work commences on a Clients request, A Jellyfish Company will send update messages through Discord/Twitter DMs & an estimated completion date.At this stage minor alterations can be made to its design content.A Jellyfish Company reserves the right to share (art/writing) WIPs to social media unless the Client expresses this not to be done. eg a surprise presentOnce the Request is complete A Jellyfish Company will email the Client a watermarked digital photo of the finished work. At this stage only very minor adjustments can be made.CopyrightA Jellyfish Company retains the copyright to the work created from the Client’s request. A Jellyfish Company will not reproduce the work & its usage will not be allowed on any other website apart from A Jellyfish Company website and social media pages, unless the Client gives written permission to do so.A Jellyfish Company reserved the right to display the work on their website and social media pages. If a Client is unhappy about the work being displayed, they must declare this upon placing the commission.The Client retains ownership of the work but must obtain permission to share the work on social media. If the client wishes to make any reproductions of the work then this must be arranged through A Jellyfish Company only.All NSFW works will not be posted with A Jellyfish Company’s direct profile, and instead be credited to simply as Anonymous on any public platforms. Linking back to any names publicly tied to A Jellyfish Company will not be tolerated in any circumstances.However, A Jellyfish Company is allowed to make exceptions for any work as they deem so.Up-front PaymentA Jellyfish Company requires a 50% upfront payment from the Client to confirm a commission request. This deposit is refundable if there is no work done yet.PaymentsInvoices will be issued by A Jellyfish Company upon completion of the work & before delivery. Invoices are primarily sent via Discord/Twitter DMs. Payment in full is due within 7 days of invoice. Please note, unless specifically agreed to by both parties prior to the issuing of an invoice, A Jellyfish Company does not accept payment in part or via installments.A Jellyfish Company accepts payment by the following methods (in order of preference):Paypal
GCash
ShopeePay (Philippine Clients)For termination before completion of commissionIf the client chooses to terminate the services of A Jellyfish Company after agreeing a commission arrangement but before the commissioned project is complete, A Jellyfish Company reserves the right to retain any non-refundable deposits paid.Should the Client cancel the commission agreement after the work has been completed, A Jellyfish Company reserves the right to charge up to 70% of the total projected costs. The scale of the charge will be dependent on the discretion of A Jellyfish Company and the stage of the project at the time of cancellation.There are fees for Commercial and Academic usage.If communication breaks down on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication from A Jellyfish Company ) A Jellyfish Company will issue a warning email. If this warning email is not replied to (and communication does not resume) within the following period of 1 week, A Jellyfish Company reserves the right to terminate the commission. In this event, all deposits paid will be retained by A Jellyfish Company and the commission will be cancelled.If the Client wishes to continue the commission at a later date they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.AI ClauseUnder in no circumstance is A Jellyfish Company’s work is to be put through any kind of generative or any similar AI (eg. ChatGPT, Gemini, Grammarly, Quillbot) without EXPLICIT WRITTEN PERMISSION.Violation of this clause will lead to a mass report, and blacklisting from any of A Jellyfish Company’s services.Additional ClauseIf A Jellyfish Company fails to meet the expected deadline for a commission, they will only charge 70% of the original agreed price.A Jellyfish Company is allowed to freely decline any commission as they see fit.Custom prices are negotiable.
